Terms of Service & Booking Conditions
1. Agreement Scope & Entity Identification
These Terms of Service ("Terms") constitute a legally binding contract between you ("Guest", "Client", or "User") and Encoretemponst S.r.l. ("Encoretemponst", "we", "our", or "the Company"), registered under Italian law with Company Registration Number IT-09823481203, with primary headquarters at Via della Spiga 28, 20121 Milano (MI), Italy.
By accessing our website, interacting with our 3D spatial architecture tools, or executing a charter agreement for any curated property in our portfolio, you accept and agree to be bound unconditionally by these Terms.
2. Reservation Protocols, Deposits, & Balances
To confirm a private estate charter or boutique villa reservation:
- Deposit Requirements: A non-refundable commitment deposit of 30% of the total charter fee is required at the time of written reservation confirmation.
- Final Balance: The remaining 70% balance, together with the specified Security Deposit (Deposito Cauzionale), must be cleared no later than 45 days prior to the agreed arrival date.
- Security Deposit: A refundable security deposit is held to cover incidental property damages, extraordinary staff overtime, or specialized consumption charges. This sum is released within 14 business days following check-out inspection.
3. Guest Obligations, Occupancy Limits, & Heritage Protection
Our properties include historic monumental assets protected under Italian cultural preservation regulations (Beni Culturali). Guests agree to:
- Observe the maximum declared guest count. Subletting, unannounced day guests, or commercial photography without prior written authorization is strictly prohibited.
- Furnish valid government passports or national identity cards for all occupants at least 48 hours prior to check-in to comply with Italian Police reporting mandates.
- Treat historic frescoes, stone masonry, antique furnishings, and landscaped grounds with utmost care.
4. Cancellation, Force Majeure, & Rescheduling
Cancellations must be communicated in writing to [email protected].
- More than 60 days before arrival: Full credit note valid for 24 months across any property within the Encoretemponst portfolio.
- 30 to 59 days before arrival: 50% refund of total charter amount (excluding the initial deposit).
- Fewer than 30 days before arrival: No refund permitted; guests are strongly advised to secure comprehensive travel and trip cancellation insurance.
- Force Majeure: Neither party shall be liable for failure to perform due to seismic events, volcanic disruptions, declared national state of emergency, or maritime navigation bans beyond reasonable control.
5. Intellectual Property Rights
All digital visual media, 3D WebGL assets, architectural renderings, editorial narratives, logos, and custom layout frameworks presented on this domain remain the exclusive intellectual property of Encoretemponst S.r.l. Any reproduction, automated scraping, or unauthorized redistribution without explicit license is actionable under Italian and EU intellectual property law.
6. Governing Law & Exclusive Jurisdiction
These Terms and all disputes arising from estate charter contracts shall be governed exclusively by the laws of the Republic of Italy. Any legal controversy or litigation shall be submitted to the exclusive jurisdiction of the Courts of Milan (Tribunale di Milano), Italy.
